JONATHAN TROTTO: Probate is the process of bringing a will to Surrogate's Court and having Surrogate's Court appoint an executor to take care of someone's estate. A person's estate consists of all their assets that are in their name alone.
I recommend that everyone have a will. What a will does is to make sure that your property goes to who you want it to go to. A trust is another way of planning for your estate and planning for your family members. You can protect your assets from probate and from creditors by setting up a trust.
Every person should have an
estate plan. An estate plan just doesn't involve a will, it involves making sure the person has a power of attorney and a health care proxy. The will takes of you after you pass away. The power of attorney and the health care proxy takes care of you while you're alive.
