- Courts are allowed to apply these percentages to income beyond the combined parental income threshold (currently $130,000), but they are not required to do so.
- Courts consider the needs of the child. This can include his or need to have the same lifestyle after the divorce. It can include continuation of private school tuition or expensive extracurricular activities.
- If the higher income parent loses his or her job, he or she must quickly seek a modification of the original child support order to change the amount owed.
- A child is entitled to support even if the parents were never married.
- The custodial parent must prepare a budget that details the cost of raising the child and that demonstrates that the amount provided by the child support calculator is insufficient.
- Visitation time awarded to the non-custodial parent affects the amount of child support he or she will need to pay.
